Datamails Terms of Service

Welcome to Datamails, a service provided by Valorize Media ("we", "our", "us"). By using our platform ("Service"), you agree to comply with these Terms of Service ("Terms"). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By accessing or using Datamails, you agree to be bound by these Terms and any additional guidelines, policies, or rules published on the platform, including our Privacy Policy. If you do not agree with these Terms, you must stop using the Service immediately.
2. Description of Service
Datamails is a SaaS platform for e-commerce brands that connects to third-party services (e.g., Klaviyo, Shopify, Postscript) to analyze customer data and provide insights. The Service is metered based on the number of active Klaviyo profiles connected to the platform.
3. User Accounts
You must create an account to access and use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. Subscription and Billing
Datamails operates on a subscription model with pricing based on the number of active Klaviyo profiles linked to the Service.
By subscribing, you agree to pay the applicable fees based on the number of active profiles.
Subscription fees are charged on a recurring basis, and you authorize us to charge your payment method on the agreed billing cycle.
5. Cancellation and Termination
You may cancel your subscription at any time through your account settings.
When you cancel your subscription, you will continue to have access to the Service until the end of your current billing period. After the billing period ends, access to the Service will be revoked, and no further charges will be incurred.
We reserve the right to suspend or terminate your account if you violate any of these Terms or engage in illegal activities.
6. Refund Policy
Datamails operates a no-refund policy, meaning that once you have paid for a subscription term, no refunds will be provided except under certain exceptional circumstances.
Refunds will only be issued if we are unable to deliver the Service due to technical issues beyond our control or if the Service becomes unavailable for an extended period without resolution. In such cases, refunds will be issued at our sole discretion.
If you cancel your subscription, you will not be eligible for a refund of any unused portion of the billing period.
7. Service Availability and Modifications
We make every effort to ensure the Service is available 24/7. However, we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We are not responsible for any unavailability or loss of data.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
8. Use of Third-Party Services
Datamails integrates with third-party services such as Klaviyo to provide its core functionality. By connecting your account to these services, you authorize us to access, retrieve, and process data from these services on your behalf.
We are not responsible for the availability, accuracy, or functionality of these third-party services. You are responsible for complying with the terms and conditions of any third-party services you use in connection with Datamails.
9. Data Privacy and Security
We take your privacy and data security seriously. Please refer to our Privacy Policy for more information on how we collect, store, and use your data.
You are responsible for maintaining the security of your account credentials and ensuring that your data shared with third-party services complies with applicable laws and regulations.
10. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims related to the Service is limited to the amount you paid for the Service during the last billing period.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on our website, and your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any legal action or proceeding related to these Terms or your use of the Service will be brought exclusively in the courts of Ahmedabad, Gujarat, India. You agree to submit to the jurisdiction of, and venue in, such courts, and waive any objection as to inconvenient forum.
If you are accessing the Service from outside India, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
